Pakem Terms of Service

1. Who we are and what this agreement covers

These Terms apply between Muhammad Zaid Taufiq Yasyaf, an individual, Indonesia ("Pakem", "we") and the business that subscribes to Pakem ("Customer", "you"). They also cover staff who use Pakem under that subscription ("Staff User"), where a section says so. The Privacy Policy is part of these Terms.

2. The service

Pakem is a web platform for cafés, restaurants and chains. Admins and staff use it for SOP workflows, shifts and time off, users and roles, and stores. Features are shown on our website. A feature listed as "coming soon" or "beta" is not part of the subscription until it is released.

3. Accounts and subscription

  • You must give accurate information and keep your login secure.
  • Your plan is set out in writing before you subscribe.

4. Paid plans, fees and payment

  • Seller of record. Paid subscriptions are sold by Polar Software, Inc. as merchant of record and authorized reseller. Polar processes payment, collects applicable tax, issues invoices and handles chargebacks. Polar's Buyer Terms apply to each purchase. Pakem provides the software.
  • Price. Plans are charged per store, per year, prepaid annually, at the price shown at checkout. Charged in USD through Polar. Tax is included where applicable.
  • Trial. A trial, where offered, is as shown when you sign up. No charge is made until you pay. If a trial ends without payment, the account is suspended (read-only). If it stays unpaid, the account is closed and the retention rule in the Privacy Policy applies.
  • Store changes. Adding stores is charged pro-rata from the date added to the end of the paid year. Removing stores takes effect at the next renewal; there is no mid-term credit.
  • Renewal and cancellation. Paid subscriptions renew automatically each year until you cancel. Cancellation takes effect at the next billing cycle, through the account or by emailing pakem@uncle-z.com.
  • Refunds. See the Refund Policy.

5. Service availability

We work to keep the service available but do not guarantee uninterrupted access.

6. Your responsibilities

You are responsible for:

  • having a lawful basis for the staff data you put into Pakem and telling your staff how it is used;
  • the content you upload and the accuracy of your records;
  • keeping your users' access under control.

7. Data processing

Where we process staff personal data for you, we act as your processor. We will provide our data processing agreement before you enter staff personal data.

8. Staff users

  • Staff Users with accounts you create may use Pakem under your subscription. You control their access, and you are responsible for the accounts you create.
  • Pakem records and shows operational data. It does not guarantee any employment outcome.

9. AI features

Pakem does not currently offer AI features. We will update these Terms before any AI feature is released.

10. Acceptable use

You must not use Pakem to break the law, to store data you have no right to store, to attack or probe our systems, to resell the service without a written agreement, or to post false or abusive content.

11. Intellectual property

Pakem and its software, designs and content belong to us or our licensors. You keep the rights to the data you put into Pakem. You give us a limited licence to host, process and display that data to provide the service.

12. Third-party services

Pakem uses third-party services (hosting, email, analytics, and Polar for payments), listed in the Privacy Policy. We are not responsible for third-party services outside our control, except as the law requires.

13. Suspension and termination

  • We may suspend an account for non-payment, a breach of these Terms, or a risk to the service or other users. We will tell you why, where the law allows.
  • Either party may end the subscription.
  • On termination, you can export your data before the subscription ends. After that we delete or return it under our data processing agreement, except where the law requires us to keep it.

14. Liability

Nothing in these Terms limits any right you have that cannot be excluded under Indonesian law.

15. Changes to these Terms

We will give notice of material changes in advance, before the change takes effect. If you keep using Pakem after they take effect, you accept them.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Indonesia. First, the parties try to settle the dispute by good-faith discussion. If that fails, the district court (Pengadilan Negeri) of Indonesia with jurisdiction decides.

17. Language

The Indonesian version prevails.
